## 1. Acceptance of These Terms

These Terms of Use govern your access to and use of NVOX.org, including its pages, content, forms, materials, communications, and related services controlled by NVOX FOUNDATION INC.

By accessing or using the website, you agree to these Terms and acknowledge the Privacy Policy.

Please do not use the website if you do not agree to these Terms.

Additional terms, notices, consents, or agreements may apply to a particular Foundation program, research collaboration, event, submission, or activity. If additional terms apply, they will supplement these Terms for that specific activity.

## 2. About the Foundation

NVOX FOUNDATION INC., referred to in these Terms as the Foundation, is a nonprofit organization focused on expanding access to responsible ADHD assessment, advancing research, and improving public understanding through education, culture, creativity, and community.

The website provides information about the Foundation, its mission, its programs, and opportunities to contact, support, or collaborate with the Foundation.

## 3. Separate Organizations

NVOX FOUNDATION INC. and NVOX Inc. are legally and operationally separate entities.

NVOX Inc. operates the clinical and technological platform behind NVOX.com.

The Foundation leads public benefit initiatives across assessment access, research, culture, education, community, and philanthropy.

The Foundation may use NVOX.com infrastructure for programs aligned with its mission through documented and appropriately governed arrangements.

Access to NVOX.org does not create an account with NVOX.com and does not enroll you in any clinical service operated by NVOX Inc.

Your use of NVOX.com is governed by the separate terms, notices, permissions, and privacy practices applicable to that platform.

## 4. Informational and Nonclinical Nature of the Website

NVOX.org is a public informational website.

The website does not provide medical, psychological, psychiatric, educational, financial, tax, or legal advice.

Website content is not a substitute for an evaluation, diagnosis, treatment recommendation, or professional relationship with a qualified provider.

Submitting a form through NVOX.org does not create a clinician and patient relationship, therapist and client relationship, attorney and client relationship, fiduciary relationship, or other professional relationship.

The general contact form is not intended for urgent or emergency communications.

If you believe that you or another person is in immediate danger, contact the appropriate local emergency services.

## 5. Eligibility and Minors

The general website and contact form are intended for adults.

A parent or legal guardian must submit an Assessment Access inquiry on behalf of a minor.

Children under 13 may not submit personal information directly through the general contact form.

By using the website or submitting a form, you represent that you are legally able to agree to these Terms or that you are acting with appropriate authority on behalf of another person or organization.

## 6. Permitted Use

You may use the website for lawful, personal, professional, educational, informational, charitable, or institutional purposes consistent with the Foundation’s mission.

You may view, download, or print publicly available materials for your own noncommercial use, provided that you do not remove notices, alter the meaning of the materials, or suggest that the Foundation endorses you or your activities.

Any other use requires prior written permission from the Foundation or the applicable rights holder.

## 7. Prohibited Conduct

You may not use the website to:

- Violate any applicable law or regulation
- Submit false, misleading, fraudulent, or impersonated information
- Interfere with the operation, security, or availability of the website
- Attempt to gain unauthorized access to systems, accounts, records, or information

The Foundation may restrict or terminate access to the website when it reasonably believes these Terms have been violated or when necessary to protect the website, the Foundation, or other individuals.

## 8. Assessment Access Inquiries

The Foundation may provide opportunities to inquire about programs intended to reduce financial or systemic barriers to ADHD assessment.

Submitting an inquiry does not guarantee eligibility, acceptance, funding, availability, placement, timing, or access to an assessment.

Program availability may depend on location, age group, clinical capacity, funding, licensing requirements, program criteria, and the current stage of the initiative.

The general inquiry form is not intended for detailed medical records, diagnostic reports, identity documents, banking information, or financial eligibility materials.

If additional sensitive information is required, the Foundation may provide a separate notice, consent request, and appropriate submission process.

When an eligible participant is connected to an assessment through NVOX.com, the assessment is provided separately through the platform operated by NVOX Inc. Additional terms, permissions, and privacy notices will apply.

The Foundation may support access to an assessment, but it does not determine the clinical result. Clinical decisions are made by appropriately licensed professionals.

## 9. Research Proposals and Data Access

Researchers and institutions may use the website to propose retrospective studies, prospective studies, independent validation, or other research collaborations.

Submitting a proposal does not guarantee:

- Approval of the proposal
- Access to information or research infrastructure
- Funding or operational support
- Ethical or institutional approval
- A research partnership
- Publication

Endorsement by the Foundation or NVOX Inc.

Research access is not provided through the public website.

Any approved access may require scientific review, ethical or institutional approval, a defined protocol, a data use agreement, security controls, confidentiality obligations, publication terms, and other safeguards.

Clinical information is not available as an open research database.

Unless a written confidentiality agreement is already in place, you should not submit confidential, proprietary, unpublished, or commercially sensitive information through the general contact form.

## 10. Partnership and Collaboration Inquiries

You may contact the Foundation regarding institutional, professional, clinical, cultural, creative, community, media, or other potential collaborations.

Submitting an inquiry or proposal does not create a partnership, agency, employment relationship, volunteer appointment, advisory role, funding obligation, sponsorship, or commitment by the Foundation.

No person may represent, bind, or make commitments on behalf of NVOX FOUNDATION INC. unless that authority has been provided in writing by an authorized representative of the Foundation.

Any collaboration will be subject to separate review and, where appropriate, a written agreement.

## 11. Personal Stories and Creative Materials

You may have an opportunity to submit a personal story, photograph, recording, artwork, interview concept, project proposal, or other material.

You retain ownership of material that you submit, subject to any rights held by others.

By submitting material, you grant the Foundation a limited, nonexclusive permission to receive, store, review, internally reproduce, and share the material with its authorized personnel, advisers, and service providers as reasonably necessary to evaluate and respond to the submission.

Submission does not authorize the Foundation to publicly publish or use an identifiable personal story, image, voice, recording, or creative contribution.

Any public use of identifiable material will require appropriate permission or a separate release agreement.

You represent that you have the right to submit the material and that doing so does not violate another person’s privacy, confidentiality, intellectual property, publicity, or other legal rights.

The Foundation is not required to accept, publish, return, preserve, or respond to submitted material.

## 12. Unsolicited Ideas

The Foundation welcomes thoughtful inquiries but cannot guarantee that ideas, concepts, formats, projects, or proposals submitted without a written agreement will be treated as confidential.

The Foundation or its partners may already be developing or considering ideas that are similar to a submission.

Submitting an idea does not create a right to compensation, attribution, participation, ownership, or future involvement unless the Foundation agrees otherwise in writing.

This section does not limit the Foundation’s obligations under its Privacy Policy regarding personal information.

## 13. Intellectual Property

The website and its original content, structure, text, graphics, design, images, video, audio, software, and other materials are protected by intellectual property and other applicable laws.

Names, logos, service names, project names, slogans, and other marks displayed on the website are owned by or used with permission from their respective owners.

Nothing on the website grants you ownership of or a license to use any trademark, logo, copyrighted work, technology, data, or other intellectual property except as expressly stated in these Terms.

You may not reproduce, modify, distribute, sell, license, publicly display, publish, create derivative works from, or commercially exploit protected website material without prior written permission from the applicable rights holder.

## 14. Accuracy and Availability

The Foundation seeks to provide accurate and useful information.

However, programs, research initiatives, partnerships, eligibility criteria, availability, dates, content, and website functionality may change.

The Foundation does not guarantee that all information will always be complete, current, error free, or available without interruption.

The Foundation may correct, update, remove, suspend, or replace content or functionality at any time.

## 15. External Websites and Third Party Services

NVOX.org may contain links to NVOX.com, research institutions, cultural initiatives, social platforms, service providers, and other independent websites or services.

A link does not necessarily mean that the Foundation endorses, controls, or accepts responsibility for the linked website, organization, content, products, services, or privacy practices.

Your use of an independent website or service is governed by the terms and policies of that third party.

You are responsible for reviewing those terms before using the relevant website or service.

## 16. Privacy

The Foundation’s collection and use of personal information through NVOX.org are described in the Privacy Policy.

By submitting information through the website, you acknowledge that the information will be handled as described in that Policy and in any additional notice provided for a particular program.

Please do not submit sensitive information through the general contact form unless the Foundation specifically requests it and provides an appropriate method.

## 17. Electronic Communications

When you contact the Foundation electronically, you consent to receive communications related to your inquiry, submission, proposal, program, or relationship with the Foundation.

Electronic communications may include email or other methods you have requested or authorized.

You are responsible for providing accurate contact information and maintaining the security of your own email and devices.

Promotional communications will include an unsubscribe option where required.

## 18. Disclaimer of Warranties

To the fullest extent permitted by applicable law, NVOX.org and its content are provided on an as available and as is basis.

The Foundation does not make warranties, express or implied, regarding the website’s uninterrupted availability, security, accuracy, completeness, suitability, or freedom from harmful components.

The Foundation does not warrant that using the website or submitting an inquiry will produce a particular result, response, opportunity, service, partnership, or program outcome.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

## 19. Limitation of Liability

To the fullest extent permitted by applicable law, NVOX FOUNDATION INC. and its directors, officers, personnel, volunteers, contractors, advisers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

- Your use of or inability to use the website
- Reliance on website content
- A delay, interruption, error, or security issue
- An external website or third party service
- A submission, inquiry, proposal, or communication
- Unauthorized access to information despite reasonable safeguards

The Foundation is not responsible for losses caused by events beyond its reasonable control.

Nothing in these Terms limits liability where limitation is prohibited by law, including liability for fraud, intentional misconduct, or another matter that cannot lawfully be excluded.

## 20. Responsibility for Misuse

The Foundation reserves the right to control the defense of a claim involving the Foundation, subject to applicable law and any separate written agreement.

The Foundation may introduce, modify, suspend, limit, or discontinue any website feature, program, application process, research initiative, collaboration opportunity, or public activity.

The Foundation is not required to continue any program or maintain any particular level of availability.

Where appropriate, the Foundation may provide notice of a material program change, but it is not required to provide advance notice in every circumstance.

## 22. Changes to These Terms

The Foundation may update these Terms as the website, its programs, or applicable requirements change.

The updated Terms will be posted on this page with a revised date.

Changes become effective when posted unless another effective date is stated.

Your continued use of the website after an update means that you accept the revised Terms.

If you do not agree to the revised Terms, you should stop using the website.

## 23. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

Any dispute arising from or relating to these Terms or the website must be brought in a state or federal court located in Delaware, and each party consents to the jurisdiction of those courts.

This section does not limit any mandatory consumer protection or other legal right that cannot be waived under the laws applicable to you.

## 24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

## 25. No Waiver

The Foundation’s failure to enforce a provision of these Terms does not waive its right to enforce that provision or another provision later.

## 26. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to a specific program or activity, form the agreement between you and the Foundation regarding your use of NVOX.org.

They do not replace a separate written agreement governing a research project, partnership, release, event, service, or other specific relationship.
